ALLGEMEINE GESCHÄFTSBEDINGUNGEN

[01] Geltungsbereich

Alle unsere Lieferungen und Leistungen erfolgen ausschließlich auf der Grundlage dieser AGB. Abweichende Regelungen gelten nur bei vorheriger, schriftlicher Bestätigung durch GOODBOIS.

[02] Angebot

Die Produktabbildungen sind graphische Darstellungen und können leicht von der gelieferten Ware abweichen. Alle angegebenen Preise sind in Euro-Währung ausgezeichnet. Porto- und Verpackungskosten kommen gemäß der gesonderten Versandbedingungen hinzu. Es gelten stets die Preise aus dem aktuellen Online Store.

[03] Bestellung & Bezahlung

Du kannst über unsere Homepage jederzeit bei uns bestellen. Die Bezahlung erfolgt per Kreditkarte, Vorkasse mit Banküberweisung oder per Paypal.

[04] Vertrag & Lieferung

Durch deine Bestellung bei GOODBOIS gibst Du ein verbindliches Angebot zum Abschluss eines Kaufvertrages ab. Der Kaufvertrag kommt durch Annahme der Bestellung durch GOODBOIS innerhalb der folgenden 14 Tage zustande und wird mittels einer Auftragsbestätigung (per E-Mail) angenommen. Produkte, die nicht in der Auftragsbestätigung enthalten sind, sind kein Bestandteil des Kaufvertrages! Sollte dein Angebot nicht innerhalb von 14 Tagen bestätigt werden, gilt es als abgelehnt. Für den Fall, dass GOODBOIS nicht in der Lage sein sollte, die bestellte Ware zu liefern, behalten wir uns ausdrücklich das Recht vor von dem Vertrag zurückzutreten.

Wir liefern vorrätige Ware in der Regel innerhalb von 2-5 Werktagen ab Zahlungseingang per Post an dich aus. Sollte ein Artikel nicht oder nicht so schnell lieferbar sein, so teilen wir dir schnellstmöglich den Liefertermin mit, oder alternativ, dass die Lieferung nicht erfolgen kann. Wir behalten uns vor, eine Teillieferung vorzunehmen, sofern dies für eine schnelle Abwicklung vorteilhaft erscheint. Sämtliche Angaben und Vereinbarungen über voraussichtliche Liefertermine und Zeiträume sind unverbindlich!

[05] Widerrufsrecht

Das Widerrufsrecht gilt für den Versand innerhalb der Bundesrepublik Deutschland, ebenso in der Europäischen Union. Es besteht nicht für versiegelte Ware, wenn die versiegelte Verpackung geöffnet oder beschädigt wurde (Entsiegelung). Du bist an deine Bestellung nicht mehr gebunden, wenn du innerhalb einer Frist von 14 Tagen nach Erhalt der Ware Widerruf einlegst. Der Widerruf muss keine Begründung enthalten und schriftlich per Brief oder E-mail erfolgen an: home@goodbois.net

Zur Fristwahrung muss eine rechtzeitige Absendung der Ware samt schriftlichem Widerruf erfolgen an:

Im Falle eines Widerrufs des Warenkaufs erstatten wir bereits geleistete Zahlungen nach Rückerhalt der Ware zurück. Wir erstatten keine Rückversandkosten. Die Bearbeitungsdauer für Zahlungs-Rückerstattungen beträgt etwa 30 Werktage. Benachrichtige uns bitte über eine Rücksendung in jedem Fall. Bei Rücksendung beschädigter oder benutzter Ware ist GOODBOIS berechtigt Schadenersatzansprüche geltend zu machen. Originaletiketten an der Ware dürfen nicht entfernt oder beschädigt werden.

[06] Haftung

GOODBOIS übernimmt keine Haftung für eventuelle Schäden, die durch die Benutzung gekaufter Produkte, insbesondere bei unsachgemäßem Gebrauch, entstehen. Schadensersatzansprüche sind ausgeschlossen, es sei denn, der Schaden wurde durch uns vorsätzlich oder durch grobe Fahrlässigkeit verursacht.

[07] Gewährleistung

Die Gewährleistungsfrist beträgt 24 Monate ab Ablieferung. Bei Reklamationen muss das Kaufdatum mit einer Rechnung nachgewiesen werden. Der reklamierte Artikel muss zusammen mit einer Kopie der Rechnung an SKYNET c/o GOODBOIS, Behringstr. 10, 82152 Planegg, Deutschland geschickt werden. Die Gewährleistung erstreckt sich nicht auf den normalen Verschleiß oder die Abnutzung der Ware. Die Gewährleistung erlischt, wenn der Kunde die gelieferte Ware physisch verändert.

[08] Pflege

Orientiere dich bitte an standardmäßigen Waschanleitungen für ähnliche Textilien. Schäden durch falsche Reinigung werden nicht von uns übernommen.

[09] Rücktrittsrecht

Bei Schreib-, Druck- und Rechenfehlern auf der Website, in Anzeigen oder Flyern ist GOODBOIS zum Rücktritt von hierauf beruhenden Verträgen berechtigt.

[10] Eigentumsvorbehalt

Bis zur vollständigen Bezahlung bleibt die Ware Eigentum von GOODBOIS.

[11] Datenspeicherung

Die für die Geschäftsabwicklung notwendigen Daten werden gespeichert und im Rahmen der Bestellabwicklung ggf. an mit uns verbundene Unternehmen weitergegeben. Alle personenbezogenen Daten werden selbstverständlich vertraulich behandelt. Deine schutzwürdigen Belange werden dabei von uns berücksichtigt.

[12] Widerspruchsrecht nach dem Bundesdatenschutzgesetz (BDSG)

Du hast als Betroffener nach dem BDSG ein Widerspruchsrecht zur Nutzung oder Übermittlung deiner Daten für Werbezwecke (Sperrkennzeichen). Daneben besteht ein Recht auf Auskunft sowie, unter bestimmten Vorraussetzungen ein Recht auf Berichtigung, Sperrung und Löschung deiner von uns gespeicherten Daten.

[13] Gerichtsstand

Gerichtsstand für alle Ansprüche ist, soweit zulässig, München.

[14] Anwendbares Recht

Es gilt ausschließlich Deutsches Recht unter Ausschluss des EU-Kaufrechts. Dies gilt auch, wenn sich dein allgemeiner Gerichtsstand im Ausland befindet.

[15] Salvatorische Klausel

Sollte eine der vorstehenden Bestimmungen nichtig sein oder werden, so bleibt die Gültigkeit der anderen Bestimmungen erhalten.
